On the status and the short-term tasks for customs authorities of the Russian Federation taking into account their current resource’s provision

German Gref, Minister of Economical Development and Trade who spoke at the meeting of the Board of the Federal Customs Service (FCS) articulated the major task for customs authorities of Russia: “Provision of radical improvement of customs administration at the border of the Russian Federation”.

Alexander Zherikhov, Head of the FCS made the main report. He presented in his report the Plan on measures on implementation of the Concept of development of customs authorities of the Russian Federation, which had been worked out by the FCS of the Russian Federation together with the departments of the Ministry of Economical Development and Trade.

The activity of customs authorities at present stage is characterized by the following parameters.

More than 2.1 trillion rubles or 74.3 billion United States dollars of customs charges were paid to the federal budget in 2005. It was by 882.7 billion rubles or 31.99 billion dollars more than in 2004. Monthly growth of import customs payments is observed. In 2005 such payments reached 750.3 billion rubles or 26.5 billion United States dollars, which was by 33% more than in 2004.

The adoption and entry into force, starting from January 1rst, 2004 of the new Customs Code created the preconditions for the liberalization of foreign trade activity and implementation of customs procedures accepted all over the world, such as electronic declaring, the system of risks management, post audit.

Currently 99.9% of customs declarations are processed within three days as stated in the Customs Code,   95% of import goods are released on the same day, when a declaration is submitted, which is positive in terms of raising budget revenues.

At the same time, performance of customs authorities is negatively affected by a number of problems.    These problems are; diminishing of customs value and unauthentic declaring of goods by the participants of foreign trade, immature system of informing on pricing, low efficiency of control based on post audit methods, inert interaction of operative divisions of customs with other law enforcement and supervising authorities, insufficient training of personnel, low motivation of personnel, and high level of malfeasance in office.

All these problems described above are the result of not yet resolved system problems, which are directly affecting the efficiency of customs performance.

The major and the most serious tasks to be resolved are related to the problems of equipment status and development as well as integrated management at the border. This is a matter of high priority and the most costly vector of the activities on implementation of the Concept of development of customs authorities of the Russian Federation, approved by the Government of the Russian Federation (Regulation of the Government of the RF dated 14.12.2005 № 2225-р).

The major idea of the transformations envisaged by the Concept is in setting up of competitive customs service, equally efficient and transparent both for the state and for the participants of foreign trade activities.

This goal may only be achieved by means of resolving the main task, setting up of crucially new system of organization of customs control and customs clearance, based on the international standards, as well as other tasks. In particular:

1. Equipping customs offices with modern engineering means of customs control.

In 2006–2010 it is planned to provide customs offices with inspectorial supervision complexes, including 50 stationary complexes (for motor transport check-points – 30; for airports – 10, for sea ports – 4, for railroad check points – 6), mobile – 22.

Each inspectorial supervision complex is to pay back within a year and half or two years.

It has been envisaged to equip customs offices with the means of customs control over fissionable and radioactive materials, communication means, scanning machines (reading equipment), and weighing equipment.

Realizing of these measures shall facilitate reduction of unauthentic declaring of goods by approximately 12% annually.

2. Development of customs border, development of border infrastructure, intended for erection, operation and maintaining of customs check-points.

It is planned to erect 149 new check-points and to upgrade 37 existing motor transport check-points.

3. Introduction of the system of integrated control at the border of the Russian Federation.

It is assumed, that the number of state control bodies in the high security regime zone at the check-points shall be reduced to two services (border and customs services), while adequate conditions of work are to be established for other control authorities.

The expected efficiency: simplification of customs clearance procedures;

Reduction of financial costs of the participants of foreign trade on customs clearance procedures (one hour of idle time at the border incurs 0.04% growth of the value of goods); increasing of throughput of customs check-points by 2010 by 18 500 motor vehicles a day.

4. Setting up of the single interagency computer-aided system of collection, storing and processing of the information, required for the control of foreign economic activity.

Setting up of crucially new system of customs control and customs clearance    presupposes realizing of “one window” (submitting of the information only once) and “one stop” (integrated customs control) principles. This system will provide for tracing in real time of the whole chain of goods supply and taking operational decisions together with other supervising authorities.

5. Setting up of operational center on processing of information and taking decisions in the structure of customs authorities.

Its major purpose will be to conduct continuous monitoring of all incoming information, and its analysis using the system of risks management and operational management of customs authorities for the purpose oriented application of the methods of selective customs control, providing for timely dealing with the threats associated with the violation of customs legislation.

In the first six months of 2006 it is planned to set up the data base of the world market prices on goods on the basis of the information provided by the manufacturers of major income generating goods. By 2009 it is planned to complete setting up of the single data base of reference prices for commodities and services, which is to be constantly maintained and updated by the Federal Customs Service.

6. The implementation of preliminary informing of customs authorities of the Russian Federation, support of the information exchange and conducting of special operations together with customs authorities of other countries.

Using of the system of preliminary informing (in other words, information exchange between the customs services), envisaged by the framework standards on the world trade security and facilitation, is going to assist in reducing of the discrepancies in the statistics of the Russian Federation and the counterparties by 10% annually, it is going to increase the efficiency of fighting unauthentic declaring of goods and diminishing of customs value.

7. Development and implementation of modern information technologies, including electronic declaring, customs audit methods, customs control after the issue in circulation (post-audit), defending intellectual rights

Realizing of these measures will allow making the system of organization of customs control and customs clearance equally transparent both for the state and for the participants of foreign trade activities. There will be formed an impersonal system of passing customs procedures, which means that a foreign trade player is not going to have a personal contact with the officials of a customs office.

8. Setting up of modern warehousing – logistical terminals.

9. Allocating of customs authorities only in the premises owned by the Federal government.

10. Implementation in customs of the international norms and regulations.

In 2006 it is planned to start transfer to the application of the Single Administrative Document of the European Union, as well as starting the creation of a new computer-aided system of customs transit control, interfaced with the all-European system (NCTS - new computerized transit system). This will facilitate one time filling out of customs documents, which will help in eradication of possibilities to enter erroneous data and will reduce the time required for customs formalities.

11. Counteraction to the phenomena of corruption and malfeasance in office within customs authorities.

The implementation of this task is impossible without setting up of the system of rotation of personnel, conducting quality alterations in the system of training, refresher training, and raising job remuneration and the level of social benefits for customs officers.

It is planned to work out an analytical program “Counteraction to corruption and malfeasance in customs authorities”.

Resource’s provision for all planned measures is to be carried out by means of their inclusion in the Federal target programs “The state border of the Russian Federation (2003 – 2010)” and “Electronic Russia” with additional allocation of funds, through another new target program “Development of the customs authorities of the Russian Federation (2006 – 2010)”, and also at the expense of current funding of customs service.

The estimates of influence of the realized measures, envisaged by the Concept, upon macroeconomic parameters in 2007-2010  have shown that full impact of the realization of all the measures is going to lead to the growth of budget revenues by 160 billion rubles a year. These measures will facilitate legalization of the shadow flow of goods, and as result, forming of additional taxable base for charging taxes administered by customs and tax authorities.

The indicators of efficiency of the measures carried out are the reduction of the discrepancy of the statistical data of foreign trade of the Russian Federation with other countries.

The implementation of the envisaged measures is going to have positive influence not only on growth of budget revenues, but also on maintaining of macro economical stability, creating of additional stimuli for the growth of domestic industries.
