  1. The present statute on the General Directorate for Federal Customs Revenues and Tariff Regulation is framed on the basis of Statute on Federal Customs Service approved by Resolution of the Russian Federation Government No. 459 dated  July 26, 2006.
  2. The General Directorate for Federal Customs Revenues and Tariff Regulation (hereinafter General Directorate) is a structural subdivision of the Russian Federal Customs Service Central Administrative Office (hereinafter FCS of Russia).
  3. General Directorate in its activities is governed by Constitution of the Russian Federation, Federal constitutional laws, Customs Code of the Customs Union, the Russian Federation Legislation on Customs Affairs, international treaties of the Russian Federation, Federal laws, acts of the President of the Russian Federation and the Russian Federation Government, regulatory legal acts of the Central Bank of the Russian Federation, Statute on Federal Customs Service, regulatory and other legal acts of the Federal Customs Service of Russia, provisions and mandates of Russian FCS Head, as well as the present Statute.
  4. Head of the Russian FCS validates the structure and the number of the personnel of the Main Directorate.
  5. The General Directorate is headed by General Directorate Head, who reports directly to Russian FCS Deputy Head, who coordinates and controls respectively the General Directorate activity in accordance with the allocation of the responsibilities among Russian FCS Head and its deputies, approved by the Head of the Russian FCS. In the absence of General Directorate Head, the overall control of the General Directorate is to be taken by the Deputy of General Directorate Head; in the absence of the First Deputy, the General Directorate is to be headed by one of the deputies of General Directorate Head, according to the allocation of the responsibilities.
  6. General Directorate Head, the First Deputy of General Directorate Head and General Directorate Head Deputies are appointed and dismissed by Head of the Russian FCS.
  7. The Main Directorate carries out its activity in the following domains:

1) organization, coordination and control over the administration, payment and collection of customs duties, taxes, administrative fines and other payments, the collection of which is entrusted to the customs authorities;

2) organization and control over the communication between the FCS of Russia and customs authorities by receipt and transfer of the information on the flow of funds;

3) organization and control over the operational accounting of customs duties, taxes, administrative fines and other payments, the collection of which is entrusted to the customs authorities, as well as report formation by the customs authorities;

4) organization and coordination of the activity of the Customs Authorities to optimize the mechanisms of payment of customs duties, taxes, administrative fines and other payments, the collection of which is entrusted to the customs authorities;

5) provision of the analysis and forecast of the Federal budget revenue value from customs payments, taxes and other charges, the collection of which is entrusted to the customs authorities;

6) development and application of technologies, accounting and control systems for estimation and payment of customs duties, taxes and other charges, the collection of which is entrusted to the customs authorities, application of benefits for payment of such fees (except for tariff preferences), including use of automated software tools;

7) carrying out of administrative procedures for provision of the public services of keeping the register of customs representatives, as well as for provision of the public services of issue and withdrawal of qualification certificates of customs operation experts by Regional Customs Directorates;

8) organization and coordination of the customs authorities’ activities, aimed for provision of payment of customs duties and taxes;

9) organization, coordination and control over application of measures of forced collection of customs fees, penalties and interests by the customs authorities;

10) organization, coordination and control over the compliance of the Customs Authorities with the Customs legislation of the Customs Union, the Russian Federation legislation in the sphere of customs affairs and other legislation of the Russian Federation while executing (putting into effect) resolutions of the customs and judicial authorities about the recovery of customs duties, taxes and other payments, the collection of which is entrusted to the customs authorities, as well as of penalties and interests for the Federal Budget revenue;

11) organization and control over money receipt for the Federal budget revenue, paid (collected) against the discharge of duty (discharge of indebtedness) of administrative fines payment with regard to administrative offence cases, the organization of the enforcement of which is entrusted to the Customs Authorities of the Russian Federation;

12) organization, coordination and control over the application by the Customs Authorities of the Customs Union customs legislation, the legislation of the Russian Federation in the domain of customs affairs, other legislation of the Russian Federation and international treaties of the Russian Federation regarding the validity of the provision of benefits on payment of customs duties (except for tariff preferences) and other exemptions from customs duties, provided by Customs;

13) in collaboration with the Federal executive authorities concerned, development of regulatory legal acts, restricting the procedures of the use of customs duty rates and payment of the customs fees, regarding energy sources (oil, oil products, natural gas and electricity, classified in group 27 of the Consolidated Foreign Economic Activity Commodity Classification of the Customs Union), as well as the procedures of import to and export from the Russian Federation territory of such goods;

14) organization and coordination of the Customs activity in the sphere of control over the payment of customs duties, taxes and other charges, the collection of which is entrusted to the customs authorities, regarding the energy sources by their import to and export from the Russian Federation territory, as well as the provision of the receipt of such payments in full into the Federal budget;

15) organization, coordination and control over the application by the Customs Authorities of the Customs Union customs legislation, the legislation of the Russian Federation in the domain of customs affairs, other legislation of the Russian Federation by the import to and export from the Russian Federation territory of energy sources within the competence of the General Directorate;

16) preparation of the proposals to the management of the Russian FCS, regarding the establishment of the competences of Customs Authorities to carry out customs operations in respect to the energy sources, imported to and exported from the Russian Federation territory;

17) organization and coordination of the determination of customs duty rates, special, anti-dumping and countervailing duties, as well as preliminary special, preliminary anti-dumping and preliminary countervailing duties, taxes, customs fees in respect to the goods, imported to and exported from the Russian Federation territory for the customs use;

18) monitoring of the compliance of the legal entities, included in the register of customs representatives, with the conditions to enter the mentioned above register, as well as control over their reports in accordance with the Russian Federation Customs legislation;

19) participation in the customs control after the release of goods by means of  the customs check and other forms of customs inspection, specified in the Customs Union customs legislation and the Russian Federation legislation in the sphere of customs affairs, within the General Directorate competence;

20) preparation of the proposals to the management of the Russian FCS, concerning the improvement of forms and methods of carrying out of customs operations and customs control; 

21) within the competence of the General Directorate, preparation of the proposals, concerning the improvement of the risk management system, to forward these proposals to the department of the FCS of Russia, coordinating the risk management system application;

22) organization, coordination and control over the allocation from the Federal budget of subsidies for compensation of the payment of import customs duties and value added taxes, incurred by legal entities and self-employed persons, who are involved in the implementation of the project of creating and operating of the territorially detached complex (innovation center "Skolkovo");

23) in collaboration with the Federal executive authorities concerned, development of regulatory legal acts, restricting the rules and procedures of allocation from the Federal budget of subsidies for compensation of the payment of import customs duty and value added tax, incurred by legal entities and self-employed persons, who are involved in the implementation of the project of creating and operating of the territorially detached complex (innovation center "Skolkovo");

24) organization, coordination and control over the provision of delays and instalment payment of the customs fees and duties;

25) preparation of the proposals for the development and improvement of legislative and other regulatory acts in the sphere of customs affairs, concerning the questions within the competence of the General Directorate;

26) participation in inspection and functional audits on the questions within the competence of the General Directorate;

27) collaboration with the Federal executive authorities on the questions, concerning the application of measures for customs tariff regulation in the Russian Federation, as well as elaboration of the proposals for the improvement of the aforementioned measures, taking into account the practices of the application of the Customs Union common customs tariff;

28) organization and coordination of the customs activity in the sphere of collaboration with tax authorities on the questions within the competence of the General Directorate;

29) collaboration with the law enforcement and other controlling authorities of the Russian Federation, while exercising the functions, given to the General Directorate;

30) preparation in the competence of the General Directorate of the proposals to the management of the FCS of Russia and to the organizational and structural Commission of the Russian FCS to optimize the structure of the General Directorate and its subordinate customs authorities.

  1. The General Directorate is the subject of the international activity of the FCS of Russia.
  2. The General Directorate departments act on the basis of the provisions, approved by General Directorate Head and prepared in accordance with the Standard Statute on the General Directorate (Directorate) Department of the FCS of Russia. Administration of the departments is carried out by their Heads.
  3. The administrative responsibilities of the General Directorate officers are determined by the job descriptions and regulations, approved according to the procedure, established by the Russian FCS.
  4. The staff of the General Directorate is composed of the people, who meet the approved qualification requirements.
  5. The activity of the General Directorate is based on the General Directorate and Russian FCS operation plans, as well as on the principles of integrated authority and personal responsibility of each official for the state of things on the entrusted area, as well as accomplishment of some missions.
  6. The General Directorate carries out its activity directly, as well as indirectly through the departments of the subsidiary customs authorities, according to the General Directorate activity domains, in cooperation with other departments of the Russian FCS, as well as with Federal Executive Authorities, public associations and other organizations and people.
  7. Workflow management and actions directed to maintain the General Directorate regime of confidentiality are carried out in accordance with the established procedure.
  8. The General Directorate observes the requirements of the Russian FCS legislation on the information security, while carrying out of its activity.
  9. The General Directorate has got a standard stamp, designed exclusively to put it on the lists and catalogues of the goods imported to and exported from the Russian Federation territory within the framework of intergovernmental agreements on the common conditions and mechanisms of support of the development of the industrial cooperation of the enterprises and industries of the CIS member-states, as well as on the industrial, scientific and technical cooperation of the enterprises of the defense industrial sector.

 

II. General Directorate Functions

 

  1. Exercises the powers of the chief administrator of the revenues of the Federal budget.
  2. Forms and provides the Ministry of Finance of the Russian Federation with the data, necessary for the development and maintenance of the cash plan.
  3. Exercises the powers of the administrator of the Federal budget revenues from customs duties, taxes, administrative fines and other payments, the collection of which is entrusted to the customs authorities, with regard to the payments, paid for the account of the Federal Treasury; coordinates and supervises the work of Customs Authorities on this activity.
  4. Carries out the accounting and control for the accuracy of the calculation and fulfilment of the receipt of the Budget in time and in full, indicating the Customs Authority code «10000000», penalties and fines for them.
  5. Takes decisions to return money, with regard to the payments, made for the account of the Federal Treasury, with indication of the Customs Authority code «10000000», as well as to return interests for such an undue return; submits the claims for return, including those received from the Customs Authorities under the jurisdiction of the FCS of Russia, to the Federal Treasury, according to the procedure established by the Ministry of Finance.
  6. Takes decisions to set off (specify) the payments to the Federal budget, with regard to the payments, paid for the account of the Federal Treasury, with indication of the Customs Authority code «10000000», and submits the claims, including those, received from the subsidiary Customs Authorities, to the Federal Treasury.
  7. Provides the Russian FCS subdivision, which carries out the budgetary accounting, with primary documents on the administered Federal Budget revenue, necessary to be reflected in the budgetary accounting. Checks the data of the budgetary accounting of the administered Federal Budget revenue.
  8. Specifies any unspecified and unidentified receipt of the money by the Customs Authorities.
  9. Develops (participates in the development) of the drafts of federal laws, legal acts of the President of the Russian Federation and the Russian Federation Government, international treaties of the Russian Federation, and the resolutions of the EurAsEC, according to the General Directorate activity domains;
  10. Organizes and provides the functioning of the central and operational systems of accounting and control over the receipt by the Federal Budget of customs duties, taxes, administrative fines and other charges, the collection of which is entrusted to the customs authorities.
  11. Organizes and control the Customs Authorities activity in the sphere of the operational accounting of customs duties, taxes, administrative fines and other payments, the collection of which is entrusted to the customs authorities.
  12. Interacts with the Federal Treasury on the questions of the information exchange organization.
  13. Organize and control the communication between the FCS of Russia and subsidiary Customs Authorities by receipt and transfer of the information on the flow of funds;
  14. For the subsidiary Customs Authorities defines the target values for the Federal budget formation with regard to the revenues, administered by the Customs Authorities.
  15. Organizes the activity of the subsidiary Customs Authorities, aimed at the improvement of the technologies of payment of customs duties, taxes, administrative fines and other charges, the collection of which is entrusted to the Customs Authorities, including the use of payment terminals, ATMs and the schemes of centralized payment of customs charges for high-volume commodity exporters and (or) importers.
  16. Collaborates with the Federal Executive Authorities in the issues of the compliance of the Customs Authorities with the target values of the Federal budget for the accounting reference period and prepares the proposals, concerning the Federal budget filling by means of receipt of customs duties, taxes and other payments, the collection of which is entrusted to the Customs Authorities, for the following and other accounting reference periods.
  17. Forecasts the receipt of customs duties, taxes and other payments, the collection of which is entrusted to the Customs Authorities, by the Federal budget on grounds of the international trade national measures.
  18. Provides the consistency of application by the subsidiary Customs Authorities of the Customs Union Customs legislation and the Russian Federation legislation on Customs Affairs, as well as the  Russian Federation legislation on Taxes and Revenues and the international legal acts, concerning the issues of accounting, payment, collection, return (set-off ) of customs duties, taxes, penalties and interests, administrative fines and other payments, the collection of which is entrusted to the customs authorities.
  19. Organizes, coordinates and controls the payment and collection by the subsidiary Customs Authorities of customs duties, special, anti-dumping and countervailing duties, as well as preliminary special, preliminary anti-dumping and preliminary countervailing duties, taxes, customs fees and other charges, collection of which is entrusted to the customs authorities;
  20. Gives methodical and practical help to the subsidiary Customs Authorities on the questions, within the General Directorate scope.
  21. Develops the procedure of provision of the public service for keeping the register of banks, other credit and insurance companies, which have the right to distribute bank guarantees for the payment of customs duties and taxes; organizes its fulfilment.
  22. Develops the blank and procedure of application of a customs quittance, issued in confirmation of depositing a caution to the pay office of the Customs Authorities or receipt of money caution to the account of the Federal Treasury.
  23. Participates in the development of drafts of regulatory legal acts of the FCS of Russia, restricting the fixed sum of payment of customs duties and taxes in regard to certain commodity types.
  24. Defines the maximum amount of a bank guarantee and the maximum amount of all concurrent bank guaranties issued by banks and other credit or insurance organizations, for the Customs Authorities to accept bank guarantees, in order to provide the payment of customs duties and taxes, according to the established procedure of the Ministry of Finance of the Russian Federation.
  25. Organizes the activity, aimed at the improvement of different methods of the provision of payment of customs duties and taxes. Controls the use by the Customs Authorities of the provision of payment of customs duties and taxes.
  26. Supervises the compliance of the banks and other credit or insurance organizations with the terms, stipulated by the Russian Federation legislation on Customs Affairs, to be included in the Register of banks and other credit or insurance organizations, entitled to distribute bank guarantees for the payment of customs duties and taxes.
  27. Develops the drafts of regulatory legal acts of the Russian Federation, regulatory and other legal acts of the FCS of Russia on the issues of the payment security of customs duties and taxes, also by customs transit of goods.
  28. Receives the payment security of customs duties and taxes, provided by legal entities in order to comply with the terms for inclusion into the Register of customs representatives, the Register of customs carriers and the Register of authorized economic operators.
  29. Receives the payment security from the legal entities, responsible for the receipt to the Federal Treasury account and (or) to the account, stipulated in the International Agreement of the Customs Union member states, of the money paid with the use of payment terminals and ATMs, so that the aforementioned legal entities comply properly with the taken responsibility.
  30. Executes the drafts of surety or pledging contracts for signing (approval), taken as security for payment of customs duties and taxes.
  31. Develops the procedure and provides the public service of keeping the Register of customs representatives.
  32. Controls the compliance of the legal entities, which are included in the Register of customs representatives, with the terms for inclusion into the aforementioned Register, as well as their provision of accounts and records, in accordance with the Russian Federation legislation on Customs Affairs.
  33. Develops the procedure of evaluation of the compliance of the people, claiming for the qualification certificate of a customs operations experts, with the qualification requirements, makes the list of the documents to be submitted together with the application for assessment permission, draws up the qualification exam program, the procedure of its passing, as well as the procedure of the qualification certificate issue.
  34. Develops the procedure of withdrawal of qualification certificates of customs operation experts.
  35. Participates in the coordination of the Customs Authorities’ activities and in determination of their competences to carry out customs operations in regard to certain commodities, transported by persons (upon certain instructions of the Russian FCS Administration).
  36. Organizes monitoring and analysis of the compliance of the Customs Authorities, international trade participants and persons with the Customs legislation of the Customs Union, the Russian Federation legislation on Customs Affairs, international treaties of the Russian Federation in the sphere of accounting and  recovery of customs duties, taxes and other payments, the collection of which is entrusted to the Customs Authorities, including the analysis of validity of application of benefits for customs duties payment (except for tariff preferences).
  37. Participates together with the Federal Executive Authorities concerned in the development of the procedure of customs administration of the energy sources imported to and exported from the Russian Federation territory.
  38. Controls the compliance of the Customs Authorities with the Common procedure of application of customs duties rate and the procedure of payment of customs charges in regard to the energy sources, as well as the compliance with the procedure of import to and export from the Russian Federation territory of energy sources, stipulated by the Russian Federation legislation.
  39. Controls the compliance of the Customs Authorities with the Common procedure of provision of benefits for customs duties and other payments (except for tariff preferences), the collection of which is entrusted to the Customs Authorities, and other customs payment relief, stipulated by the Customs legislation of Customs Union and the Russian Federation legislation on Customs Affairs and international treaties of the Russian Federation.
  40. Controls the compliance of the Customs Authorities with the Common procedure of provision of delays and (or) instalment payment of the customs fees and duties.
  41. Provides data retrieval and recording of the application of benefits and other customs duties payment relief (except for tariff preferences), delays and instalment payment of the customs fees and duties.
  42. Develops the drafts of regulatory and other legal acts of the FCS of Russia on the issues of the collection of the indebtedness of customs duties, taxes and other payments, the collection of which is entrusted to the customs authorities, as well as of penalties and interests; develops the procedure of authorization of debts of customs duties, taxes and other payments, penalties and interests, acknowledged as uncollectible.
  43. Organizes and controls the maintenance by the subsidiary Customs Authorities of the accounting system of the sums of indebtedness of customs duties, taxes and other payments, the collection of which is entrusted to the customs authorities, as well as penalties and interests, redemption and relief of the debts of  customs duties, taxes and other payments, penalties and interests, acknowledged as uncollectible, and their exemption from this accounting system.
  44. Checks the existence of the indebtedness of customs duties, taxes and other payments, penalties and interests within legal entities, so that they comply with the terms for inclusion into the Register of customs representatives, the Register of customs carriers and the Register of authorized economic operators.
  45. Works out KPIs of the subsidiary Customs Authorities’ activities in line with the General Directorate activity domains and exerts the control over their compliance, according to the procedure established by the FCS of Russia.
  46. Organizes, coordinates and monitors the compliance with the Customs legislation of the Russian Federation to provide its competence in the interests of the Russian Federation as a creditor in bankruptcy cases and in bankruptcy proceedings.
  47. Collects, consolidates and analyses the Customs Authorities’ accounts and records from the activity domains of the General Directorate subdivisions.
  48. Within its competence, during the customs inspection, provides the information confidentiality, as well as the data protection, constituting the State, bank, tax secret or other secrets protected by the law.
  49. Organizes the control over the allocation from the Federal budget of subsidies for compensation of the payment of import customs duties and value added taxes, incurred by legal entities and self-employed persons, who are involved in the implementation of the project of creating and operating of the territorially detached complex (innovation center "Skolkovo").
  50. Develops regulatory legal acts, restricting the rules and procedures of allocation from the Federal budget of subsidies for compensation of the payment of import customs duty and value added tax, incurred by legal entities and self-employed persons, who are involved in the implementation of the project of creating and operating of the territorially detached complex (innovation center "Skolkovo").
  51. Organizes and coordinates realization by the subsidiary Customs Authorities of informational and analytical procedures, development and implementation of the methods, criteria and software tools to analyze the results of the subsidiary Customs Authorities’ activities in line with the General Directorate activity domain.
  52. Participates in the cooperation with the Federal Tax Service , as well as with regional (interregional) and local tax and customs authorities, as related to the data exchange, collaboration, development and implementation of the proposals, concerning the improvement of the system of measures that will enable to provide the compliance with the Customs Union Customs legislation, the Russian Federation legislation on Customs Affairs, the Currency legislation of the Russian Federation, the Russian Federation legislation on Taxes and Revenues, in accordance with the General Directorate scope.
  53. Participates in the development and implementation of the automated customs technologies, as related to the automation of informational and analytical work in line with the General Directorate activity domain.
  54. In line with the General Directorate activity domains, prepares the proposals for implementation of the risk management system to the subdivision of the FCS of Russia that is coordinating the application of  such system.
  55. According to the established procedure of the FCS of Russia, collaborates with the customs services of the Customs Union member states, within the framework of EurAsEC, on the issues of the Customs Union functioning within the framework of EurAsEC, as related to the General Directorate scope.
  56. Organizes the analysis of the international best practices in the directions of the General Directorate activities aimed to be implemented by the Customs Authorities.
  57. Takes part in the activities of the councils and working groups on the issues related to the competence of the General Directorate.
  58. Registers and controls the lists and catalogues of the goods imported to and exported from the Russian Federation territory within the framework of intergovernmental agreements on the common conditions and mechanisms of support of the development of the industrial cooperation of the enterprises and industries of the CIS member-states, as well as on the industrial, scientific and technical cooperation of the enterprises of the defence industrial sector.
  59. Develops and submits for consideration of the management of the FCS of Russia the proposals on rates and types of customs and other duties, applied for the goods, imported to and exported from the Russian Federation territory.
  60. Develops and submits for consideration of the management of the FCS of Russia the proposals on the mechanism of collection of the customs duties, taxes and other payments, the collection of which is entrusted to the Customs Authorities, applied for the goods, imported to and exported from the Russian Federation territory.
  61. Develops and submits for consideration of the management of the FCS of Russia the proposals on the increase of administration efficiency of the benefits for customs fees (except for tariff preferences).
  62. Develops and submits for consideration of the management of the FCS of Russia the proposals on the improvement of the procedure of application of different methods of payment of customs duties and taxes.
  63. Develops and submits for consideration of the management of the FCS of Russia the proposals on the improvement of the procedure of accounting of the indebtedness of customs duties, taxes, penalties and interests, the collection of which is entrusted to the customs authorities, the collection of such indebtedness and the procedure of authorization of debts of customs duties, taxes penalties and interests acknowledged as uncollectible.
  64. Within its competence, considers petitions of the Federal Executive authorities, organizations and citizens; interacts with the representatives of the Federal Executive authorities, organizations and citizens on the matters within the competence of the General Directorate.
  65. Prepares reference and analytical material, consolidates and analyses the information on the issues of application of measures for customs tariff regulation, prepares the proposals to improve the aforementioned measures.
  66. Within the scope of the General Directorate, in case there are reasons, carries out the departmental control over the decisions, actions (inactivity) of the Customs Authorities and their officials in the sphere of Customs Affairs.
  67. Carries out functional audits of the subordinate Customs Authorities within the established General Directorate competence.
  68. Prepares draft resolutions of the FCS of Russia and proposals to eliminate customs violations and deficiencies, detected during the audits; organizes the control over their fulfilment.
  69. Prepares to Russian FCS Head the result reviews of the audits of the subsidiary Customs Authorities’ activity on the matters within the competence of the General Directorate.
  70. Participates in the development of human resources policy of the structural subdivisions of the Customs Authorities, in line with the General Directorate activity domain.
  71. Develops standard regulations on the divisions of regional customs directorates, customs and customs stations, in line with the General Directorate activity domains; participates in the development of general and individual provisions of regional customs directorates, customs and customs stations.
  72. Carries out its activity to improve the skills of the General Directorate subdivions’ officials, the divisions of regional customs directorates and customs; organizes and holds meetings, workshops, internships.
  73. Ensures the implementation of the provisions of the Administrative Regulations of the FCS of Russia on execution of state functions (public service delivery) on the matters within the competence of the General Directorate.
  74. Participates in the development, modernization, maintenance and implementation of software tools and technologies, automating the functions of the Customs Authorities, in line with the General Directorate activity domains.
  75. Participates in the international activity of the FCS of Russia, according to the procedure, established by the FCS of Russia.

 

III. General Directorate Rights

 

  1. Introduce the proposals to the Russian FCS management, concerning the General Directorate activity.
  2. Give legal entities and persons explanation, in regard to the General Directorate scope
  3. Require and receive from the Russian FCS subdivisions, Customs Authorities and institutions under the jurisdiction of the FCS of Russia any necessary statistical, analytical and other data, documents, conclusions and other information, which is necessary to take decisions concerning the General Directorate activity scope.
  4. According to the established procedure, engage the officers of the Russian FCS departments and the subsidiary customs authorities to assist in solving of problems, concerning the General Directorate scope, for the preparation of any regulatory and other legislative draft acts of the Russian FCS, as well as of other documents, and taking similar actions.
  5. Carry on correspondence with the State Authorities on the questions, concerning the General Directorate scope, in cases, defined by Russian FCS Head;
  6. Participate in the work of consultative and expert authorities within the General Directorate scope.
  7. Within its competence, collaborate with the State Authorities of the Russian Federation, the law enforcement and other inspecting State Authorities, the Executive Authorities of the Russian Federation constituent territories, local government authorities, organizations, as well as with officials and citizens.
  8. According to the established procedure, require and receive any documents and data, concerning the General Directorate scope, from the State Authorities, local government authorities, banks and other credit organizations, profit and non-profit organizations and unions, disregard the property and dependence category, as well as officers and the Russian Federation citizens, foreign citizens and persons without citizenship.
  9. Engage scientific and other organizations, scientists and specialists to solve the problems, concerning the General Directorate scope, according to the established procedure.
  10. Have the access to all the data of the audits, conducted by the Customs Authorities divisions for Customs Inspection after release of goods.
  11. According to the established procedure, use any departmental information systems, as well the ones, received from the collaboration with the Customs Authorities of the Customs Union member-states, the Russian Federation State Authorities, the Authorities of the State inspection (control) of the Customs Union member-states, within the framework of EurAsEC, and create its own databases.
  12. Within the General Directorate activity scope, take measures, aimed to cancel any unlawful decisions, actions (inactivity) of the Customs Authorities or their officers, or to provide the fulfilment of the actions, stipulated by the Customs Union Customs legislation and the Russian Federation legislation on Customs Affairs; prepare the drafts of resolutions on cancellation (revision), recognition as incompliant to the Customs Code of the Customs Union and the Russian Federation legislation on Customs Affairs of the decisions, actions (inactivity) in the Customs Affairs domain, taken by subordinate Customs Authorities and their officials.
  13. Organize the inner planning of the General Directorate to control in time the fulfilment of the functions, entrusted to the General Directorate, in accordance with the present Statute and guidelines of the Russian FCS Administration.
  14. Use other rights, stipulated by the Russian Federation legislation and other legal acts of the Russian Federation.

 

IV. Concluding Provisions

 

  1. The General Directorate Head:
    1. administers the Main Directorate activity on the basis of the integrated authority principle;
    2. takes part in the meetings, held by the Russian FCS Panel and the Russian FCS Administration, when the issues within the General Directorate scope, are considered;
    3. distributes responsibilities among its deputies;
    4. provides the recruitment and arrangement of the General Directorate, maintain the compliance with the office discipline by the General Directorate officials;
    5. creates the conditions for professional training of the General Directorate officers, as well as for the deployment of the best practices and methods of work;
    6. according to the established procedure, puts forward the nomination for special titles and grade ranks for the General Directorate officers, their post appointment, as well as proposals for their reward or imposition of disciplinary penalties;
    7. according to the established procedure, puts forward proposals for business trips to foreign countries and in the Russian Federation for the General Directorate officials;
    8. takes measures to provide the Main Directorate officers with necessary service conditions;
    9. validates the provisions of the General Directorate departments;
    10. signs documents and, within its competence, sets up the control over their fulfilment, on the basis of and in the pursuance of the Russian Federation legislation;
    11. according to the established procedure, represents the General Directorate in government bodies and other organizations;
    12. organizes and plans the General Directorate activity, as well as collaboration with other Russian FCS structural subdivisions and concerned departments of the Federal Executive Authorities, the Executive Authorities of the Russian Federation constituent territories and scientific institutions;
    13. uses rights, fulfils duties and bears responsibility in accordance with the Russian Federation legislation.
  2. The Head of General Directorate is personally responsible for carrying out of the main functions entrusted for the General Directorate, including the fulfilment of the programs, plans and the Russian FCS activity indices within the General Directorate activity scope.
  3. Assignment of functions, which are not set by the present Statute, except special (recipient-oriented) errands of the Head of the Russian FCS, is not allowed for the General Directorate.
