Areas of activities and functions of the Goods Nomenclature Directorate

Areas of activities

1) involvement in fulfillment of obligations of the Russian Federation, arising from its participation in the International Convention on Harmonized Commodity Description and Coding System of 14 June 1983, the Agreement on the Common Harmonic Code of Commonwealth of Independent States dated 3 November 1995 and the Agreement on the Common Harmonic Code of the Eurasian Economic Community dated 20 September 2002;

2) arrangement of keeping in the prescribed order and practical application of the Goods Nomenclature of foreign trade activities: the Goods Nomenclature of foreign trade activities of the Commonwealth of Independent States (CIS harmonic code), the TN VED of Russia (EurAsEc Goods Nomenclature of foreign trade activities) and their international basics;

3) participation in preparation of proposals on refining of national policy in the sphere of customs procedures and its implementation regarding keeping and practical application of the Goods Nomenclature of foreign trade activities;

4) prepering of proposals on refining of legislative and other legal acts in the sphere of customs procedures regarding matters under the Directorate’s competence;

5) arrangement and coordination of customs authority’s work on correctness of classification of goods in compliance with the TN VED of Russia, control over activities of customs authority along the stated lines;

6) arrangement and coordination of customs authority’s work on preliminary decisions making in compliance with the TN VED of Russia, control over activities of customs authority along the stated lines.

Functions of the Directorate

1. monitors changes that are made in the international basis of the Goods Nomenclature of foreign trade activities, international explanatory notes and other decisions on interpretation of this basis provisions, provides bringing the Goods Nomenclature of foreign trade activities into compliance with the international basis;

2. prepares explanatory notes and other decisions on interpretation of the Goods Nomenclature of foreign trade activities, provides their releasing;

3. provides preparing of Russian-language versions of   World Customs Organization documents relating to Harmonized Commodity Description and Coding System;

4. performs analysis of the TN VED of Russia and prepares proposals on refining of the TN VED of Russia;

5. prepares and brings proposals on classification of commodity items in compliance with the TN VED of Russia before administration of the Federal Customs Service, provides release of these decisions;

6. prepares reference and analytical materials regarding activity of the Department, colligates, analyses and prepares proposals on refining of practical application of the Goods Nomenclature of foreign trade activities;

7. participates in approving projects of international agreements of the Russian Federation and federal laws, projects of ukazes and orders from the President of the Russian Federation, projects of decrees and orders of the Government of the Russian Federation, projects of legislative and other legal acts of federal body of executive power that contain matters regarding classification of goods, the Goods Nomenclature of foreign trade activities and its international basics;

8. participates in preparing of the Customs Tariff of the Russian Federation in a part of the TN VED of Russia;

9. participates in preparing projects of decrees of the Government of the Russian Federation regarding approval of the TN VED of Russia and their updating;

10. prepares and brings proposals on preliminary decisions making on classification of goods in compliance with the TN VED of Russia before administration of the Federal Customs Service, determines nomenclature commodities on which customs authority make preliminary decisions;

11. provides operating of preliminary decisions making procedure on classification of goods in compliance with the TN VED of Russia regarding certain goods, makes preliminary and other decisions on classification of goods in compliance with the TN VED of Russia at the request of interested parties on behalf of the FCS of Russia;

12. keeps the Digest of preliminary decisions on classification of goods in compliance with the TN VED of Russia, that is posted on WEB-site of the FCS of Russia and the Registry of preliminary decisions that is included in regulatory information of the Unified Customs Automatic Information System;

13. on behalf of the FCS terminates, changes or retracts preliminary decisions on classification of goods in compliance with the TN VED of Russia regarding particular types of goods;
14. provides uniform application of the Russian Federation legislation by customs bodies regarding matters under the Directorate’s competence;

15. prepares projects of risk profiles regarding matters under the Directorate’s competence in compliance with the established procedure;

16. participates in analysis and control of risk profiles’ implementation regarding matters under the Directorate’s competence;

17. performs analyses and estimations of customs bodies’ activity regarding matters under the Directorate’s competence, and prepares proposals on improvement of customs bodies’ performance regarding these matters;

18. prepares and brings proposals on keeping customs statistical reporting regarding matters under the Directorate’s competence before administration of the FCS, and performs collection, consolidation and analysis of these data;

19. approves (initials) projects of legislative and other legal acts of the FCS of Russia regarding matters under the Directorate’s competence;

20. carries out qualificatory measures concerning customs bodies’ activity on classification of goods in compliance with the TN VED of Russia;

21. performs analysis of reports on law enforcement practice in activity of functional departments of the Regional Customs Administrations (the RCA) and the Customs, prepares recommendations and explanatory notes regarding matters set by customs bodies concerning activity of the Directorate;

22. participates in detection, suppression and prevention of administrative offenses in customs procedures; consolidates, analyses, identifies and studies tends of such offences within the range of the Directorate’s competence;

23. participates in development and adoption of measures for protection of the rights and interests of citizens and legal entities while undergoing customs procedures;

24. approves (initials) decisions of corresponding structural subdivisions of the central administrative office of the FCS of Russia concerning complaints, inquires and applications of citizens and legal entities with the subject matter of goods classification;

25. carries out departmental control of decisions made by lower customs bodies or their functionaries and activity (non-activity) performed by lower customs bodies or their functionaries regarding matters under the Directorate’s competence;

26. participates in court proceedings regarding matters under the Directorate’s competence;

27. prepares and brings projects of standard provisions about structural subdivisions of customs bodies in the sphere of the Directorate’s activity before the administration of the FCS;

28. carries out organizational supervision of structural subdivisions of customs bodies in the sphere of the Directorate’s activity, offers proposals concerning their facilities and fitting-out;

29. approves appointments to and discharges from heads of the RCA structural subdivisions and customs posts in the sphere of the Directorate’s activity;

30. participates in professional training, retraining and advanced training for the Customs officials regarding matters under the Directorate’s competence, and holds corresponding seminars and on-the-job trainings;

31. participates in arrangement and carrying out of research and development in the sphere of customs affairs;

32. participates in creating of educational materials regarding matters under the Directorate’s competence;

33. participates in meetings of working bodies of the World Customs Organization, the Commonwealth of Independent States, the Eurasian Economic Community, the common state and other international organizations in accordance with the Directorate’s activity;

34. cooperates with customs and other authorized bodies of foreign countries, international organizations in the sphere of customs affairs in accordance with the established procedure.
