Business discusses the development of tools ensuring customs transit

Immediately after the announcement in July of this year of a new form of submission of financial guarantees, the number of TIR Carnets submitted to the customs authorities, decreased by 8 percent compared to the same period of the last year. And during twenty days of August of this year, the number of TIR Carnets submitted to the customs authorities, decreased by 12 percent compared to the same period of the last year. At the same time, according to the International Road Transport Union, immediately after the announcement of the news, the sale of TIR Carnets to Russian carriers decreased by 20 %.

According to experts, there is a tendency to reduce the use of TIR Carnets by Russian and foreign carriers. International carriers increasingly scrutinize other ways of ensuring transit through the territory of Russia.

In order to provide advice, the Customs Service of Russia holds meetings with the carriers, the participants of foreign economic activity and other business representatives at all levels on practical application of measures ensuring customs transit with the use of TIR Carnets, determined by the Customs Code of the Customs Union, from September 14, 2013.

Thus, an extended meeting “On the International Transport with the use of TIR Carnets” was held in August 21, 2013 in the Central Excise Customs House. It was attended by 52 representatives from 44 companies – the participants of foreign economic activity. They discussed the problems that business faced during preparation for the application of measures to ensure transit with the use of TIR Carnets , provided by the Customs Code of the Customs Union from September 14, 2013.

The Deputy Head of the Chief Administration of the Federal Customs Revenue and Tariff Regulation of the FCS of Russia, Rustam Khakimov, explained in detail the ways of ensuring customs transit with the use of TIR Carnets (cash collateral, bank guarantee, surety contract, pledge of property). He emphasized that customs duties paid during the preliminary customs declaration of goods can be used for securing payment of customs duties and taxes during goods transportation. The possibility to use the customs duties and taxes paid during the preliminary customs declaration of goods as security for goods transportation of goods attracted particular interest of businessmen.

The document confirming the acceptance of security of payment of customs duties and taxes during the transportation of goods under the customs procedure of customs transit is a certificate of security of payment of customs duties and taxes (hereinafter – the Certificate), which shall be used in accordance with the agreement between the Russian Federation, the Republic of Belarus and the Republic of Kazakhstan “On some issues of securing payment of customs duties and taxes in respect of goods transported in accordance with the customs procedure of customs transit, on the peculiarities of collection of customs duties, taxes and on the order of transfer of the amounts collected in respect of such goods” of May 21, 2010.

Before the experiment, the carriers had to submit the certificate to the border customs authority on paper. Now, customs authorities use electronic information on the certificate for the execution of transit. The tool has become comfortable thanks to the implementation of  another information technology into the customs practice.

The participant of foreign economic activity executes the certificate of security of payment of customs duties and taxes in the domestic customs authority. The information on the certificate is entered into a Single Automated Information System of customs authorities (SAIS of CA). The electronic information on the certificate of security of payment of customs duties and taxes is used at the border for execution of customs transit.

The experiment has been carried out from August 12, 2013 (the order No. 262-p of the FCS of Russia of 09.08.2013). The customs houses subordinated to the Central, the North-Western, the Southern, the Volga Region, the Ural, the Siberia and the North Caucasus customs administrations, as well as customs houses, directly subordinated to the Federal Customs Service of Russia.

As monitoring has shown, the use of information on certificates in electronic form is convenient for both carriers (the amount of papers that make up the transit declaration is reduced), and for customs officers (they spend less time for customs operations). At the International Automobile Border-crossing Point Svetogorsk, the information on the issue of the certificate in electronic form is recorded within 2 hours and then the transit declaration is issued.
