Transfer of the medical agents, inter alia containing narcotic and psychotropic substances, via the customs border of the Eurasian Economic Union

Transfer of the medical agents by the physical bodies for the personal usage is performed in accordance with the Decision of the Board of the Eurasian Economic Commission dated April 21, 2015 No 30 On non-tariff regulation measures (hereinafter - Decision No 30).

Decision No 30 approves the following:

section 2.14 “Medical agents: of the unified list of the goods, to which non-tariff regulation measures are applied in the course of trade with the third countries and Provision on the procedure of import to the customs territory of the Eurasian Economic Union of the medical agents (hereinafter - Provision to 2.14);

section 2.12 “Narcotic drugs, psychotropic substances and their precursors” of the unified list of goods, to which non-tariff regulation measures are applied in the course of trade with the third countries and Provision on import to the customs territory if the Eurasian Economic Union and export from the customs territory of the Eurasian Economic Union of narcotic drugs, psychotropic substances and their precursors (hereinafter - Provision to 2.12).

In accordance with the law of the Eurasian Economic Union (hereinafter - the Union), physical bodies are entitled to import (export) both registered an non-registered medical agents, not containing narcotic and psychotropic substances, without provision to the customs authorities of any permit documentation (p. 4 of the Provision to 2.14).

In case if the medical agents are included into the section 2.12 of the Decision No 30 it entry is performed in accordance with the Provision to 2.12 (p. 6), according to which physical persons are entitled to import (export) limited amount of narcotic drugs, psychotropic substances and their precursors in the form of medical agents for personal administration on medical indications in case of presence of supporting medical documents with specification of name and amount of the goods. At that, in case of entry to the territory of the Russian Federation. supporting medical documents (its certified copies) shall be issued in the Russian language, or its certified translation into the Russian language shall be applied.

Such agents are subject to mandatory customs declaring procedure in the written form with attachment of the customs declaration, form and procedure of filling of which are approved by the decision of the Committee of the Customs Union dated June 18, 2010 No 287.

To get to know, whether your medical agent is subject to limitations or prohibitions in case of import (export) to (from) the territory of the Union, please review the content of the agent for the existence of narcotic and psychotropic substances.

ATTENTION! As each country has its own list of prohibited narcotic and psychotropic substances, it is obligatory to consult with the competent body of the country, which you are planning to visit, concerning the rule of import and(or) export of such medial agents.
