II. Authority Conferred by Office 
5. The Federal Customs Service shall exercise the following powers in the specified area of activity:
5.1. Introduce to the Government of the Russian Federation draft federal laws, regulatory acts and resolutions by the President of the Russian Federation and the Government of the Russian Federation and other instruments requiring that the decision be taken by the Government of the Russian Federation concerning the issues relating to the Service competence as established by Paragraph 1 of this Regulation, and draft annual work plan and projected parameters of the Service performance;
5.2. Based on and in pursuance of the Constitution of the Russian Federation, federal constitutional laws, federal laws, resolutions by the President of the Russian Federation and the Government of the Russian Federation, shall approve the following regulatory instruments in the specified area of activity:
5.2.1. Procedure for keeping registers of entities authorized to carry out Customs-related activities;
5.2.2. Procedure for keeping register of banks, other credit establishments and the insurance companies, who provide bank guarantees acceptable by customs authorities as a security of customs charges payment;
5.2.3. Procedure for keeping register of insurance companies, who provide insurance contracts acceptable by customs authorities as a security of customs charges payment;
5.2.4. Procedure for maintaining the customs register of intellectual property items;
5.2.5. Form of certificate certifying the entry into the register of entities who are authorized to carry out customs-related activities and such certificate revocation form;
5.2.6. Form and the procedure of using the customs receipt issued to confirm monetary deposit issued for the person who made such deposit in cash or transferred money on the bank account of the customs authority in coordination with the Ministry of Finance of the Russian Federation;
5.2.7. Procedure of determining customs value of goods together with the Ministry of Finance of the Russian Federation;
5.2.8. Form and procedure for the adoption of preliminary decisions as to the classification of the goods in accordance with Foreign Trade Goods Nomenclature regarding particular types of goods and the country of origin of goods;
5.2.9. Procedure and methods of customs clearance depending on types of goods transported across the customs border, the type of transport used for such transportation, categories of persons (entities) authorized to transport the goods and vehicles;
5.2.10. Form and procedure of issuing authorizations by customs authorities on the performance of customs operations;
5.2.11. Lists of documents and information, requirements to the data which are necessary for customs clearance applicable to specific customs procedures and customs regimes, and the terms of submitting such documents and information;
5.2.12. Form and procedure of completing transit declarations;
5.2.13. Form and the procedure of issuing the certificate authorizing the vehicle, container or demountable body to be used for transportation of customs-sealed goods;
5.2.14. Mandatory requirements applicable to the arrangement, refurbishment, equipment and location of temporary storage warehouses used to ensure accomplishment of customs check procedures;
5.2.15. Qualification requirements applicable to customs employees, certification procedure of the customs personnel, list of documents to be submitted together with the certification application, examination programs and testing procedures;
5.2.16. Procedure of issuing qualification certificates for the Customs personnel and the form of such qualification certificate;
5.2.17. Mandatory requirements applicable to the arrangement of duty-free warehouses should such warehouses be positioned outside the area of Russian Federation cross-border check points;
5.2.18. Procedure for customs clearance of goods to be dispatched by international mail, which require the issuance of a separate customs declaration, subject to coordination with the Ministry of Information Technologies and Communication of the Russian Federation;
5.2.19. Procedure for application of domestic customs transit regime to international mail - subject to Russian Informational Technology and Communications Ministry's approval;
5.2.20. Procedure for establishment and designation of customs control zones, requirements thereto, with exception of customs control zones established along the customs border;
5.2.21. Forms of Customs Check Certificates and Certificates of Customs Inspection of Goods and Vehicles;
5.2.22. Form of Physical Search Certificate for individuals;
5.2.23. Form of Customs Audit Certificate;
5.2.24. Procedure for taking probes or samples of goods, and also procedure for testing such probes or samples during a Customs Check;
5.2.25. Form of Certificate of change, removal, destruction or replacement by a customs authority of any means of identification in goods and vehicles;
5.2.26. Procedure and conditions of use for Customs control purposes of any information systems, information technologies and any software and accessories thereof;
5.2.27. Procedure for collection and use of Customs authorities' information resources, and requirements to information documenting, and also procedure for obtaining of the information contained in information resources, which are available to Customs authorities;
5.2.28. Procedure for the issue of licenses for establishment of a free warehouse, and their validity periods;
5.2.29. Procedure for identification of the goods imported to territory of a Special Economic Zone;
5.2.30. Requirements to arrangement, construction and a layout of a Special Economic Zone, and also conditions of accessing any Special Economic Zone to ensure effective customs control;
5.2.31. Form of application by a person resident in a special economic zone, and requirements to information statements contained in the application, for proposed importation of any goods to the territory of the special economic zone under the Free Customs Zone Customs Regime;
5.2.32. Forms of records and accounts, and also procedure and time limits, for submittal by persons conducting any activity in the territory of a special economic zone of accounts to customs authorities, - subject to Russian Finance Ministry's approval;
5.2.33. Form of Statement of Obligation to be completed by an organization importing  to the customs territory of the Russian Federation any alcoholic beverages, in respect of the use of excise marks purchased by such organization in accordance with the intended purpose of such marks;
5.2.34. Rules on purchasing excise marks for importation of alcoholic beverages and control of compliance therewith;
5.2.35. Certificates determining amounts, which are to serve as security for due performance by an organization importing to customs territory of the Russian Federation any alcoholic beverages of its obligations regarding the use of excise marks purchased by it in accordance with their intended purpose;
5.2.36. Format of designations to be applied on excise marks, which contain details of the alcoholic beverages being marked and are machine-readable for the equipment of the government's united automated information system for recording production and turnover quantities of ethylene, alcoholic beverages and other products containing alcohol, and also rules for providing a confirmation that records have been made in the Government's United Automated Information System or a notice that such recording has been refused;
5.2.37. Legal instruments regarding other matters concerning relevant activities, if such authority is provided for in Russian Federal Constitutional Acts, Federal Acts, Resolutions by the President of the Russian Federation  and Russian Government's Decrees, and also on the basis of legal instruments issued by the Central Bank of the Russian Federation;
5.3. On the basis of Federal Acts, Resolutions and Decrees of the President of the Russian Federation and the Government of the Russian Federation, and in accordance with the procedures, provided for therein, shall exercise the following powers for control and supervision concerning relevant activities:
5.3.1. Collection of customs duties, taxes, anti-dumping, special and countervailing duties, preliminary anti-dumping, preliminary special and preliminary countervailing duties, customs duties; it also supervises accuracy of assessment and timeliness of payment of the specified duties, taxes and charges, and takes measures for enforcement and compulsory collection or return thereof;
5.3.2. Ensure observance of the restrictions and limitations imposed in accordance with the legislation of the Russian Federation on Government's regulation of foreign trade activities, and in accordance with  international treaties ratified by the Russian Federation, concerning the goods being moved across the customs border of the Russian Federation;
5.3.3. Ensure and maintain uniform application by customs authorities of the Customs legislation of the Russian Federation;
5.3.4. perform customs clearance and customs checks;
5.3.5. According to established procedure, make decisions on classification of goods according to the Goods Nomenclature for foreign trade activities of the Russian Federation, and ensure publication of such decisions;
5.3.6. Provide, within the limits of its competence, protection of intellectual property rights;
5.3.7. Make, according to established procedure, decisions on classification of goods according to the Goods Nomenclature of foreign trade activities on origin of any specific goods from any specific country (Country of Origin);
5.3.8. Keep registers of persons engaged in customs operations;
5.3.9. Keep register of banks and other credit organizations having the right of issuing bank guarantees for payment of customs charges;
5.3.10. Keep register of insurance organizations, whose insurance policies may be accepted as a security for payment of customs charges;
5.3.11. Keep Customs Register of items covered by intellectual property rights;
5.3.12. Issue qualification certificates to Customs Clearance Officers;
5.3.13. Withdraw qualification certificates issued to Customs Clearance Officers;
5.3.14. Issue licenses for establishment of a free warehouse;
5.3.15. Within the limits of its competence, exercise control over currency transactions of residents and the non-residents, which involve movement any goods and vehicles across the customs border, in accordance with the Currency Control legislation of the Russian Federation and the legal instruments issued by Currency Control authorities on the basis thereof;
5.3.16. Take administrative proceedings in respect of any administrative infringements, and review such cases in accordance with the Administrative legislation of the Russian Federation;
5.3.17. Perform interrogations and urgent investigation actions in accordance with the Criminal Process legislation of the Russian Federation;
5.3.18. Perform search and apprehension activities in accordance with the legislation of the Russian Federation;
5.4. Keep customs statistics of foreign trade, and special customs statistics;
5.5. Provide information and advice, free of charge, on customs operations to persons and entities involved in foreign trade activities;
5.6. According to established procedures, keep goods nomenclatures of foreign trade activities;
5.7. As stipulated by relevant procedures and orders, design and develop information systems, information technologies, accessories and software to be used by Customs authorities;
5.8. Summarize practices of application of legislation of the Russian Federation concerning relevant activities;
5.9. Act as the main recipient and manager of the funds from the federal budget provided for the purposes of maintaining the Service and its operations.
5.10. Provide, within the limits of its competence, protection of state secret information;
5.11. Review complaints regarding customs authorities' and officials' decisions, acts (or omissions);
5.12. Organize reception of persons, provide timely and due processing of applications from persons, make decisions in respect of the applications and respond to the applications within the time limits established in accordance with the legislation of the Russian Federation;
5.13. Arrange preparedness activities within the Service, and also exercise control over and coordination of preparedness activities of organizations reporting to the Service;
5.14. Provide initial, recurrent, advance professional training and job practice of customs officers;
5.15. In accordance with the legislation of the Russian Federation, conduct work for collection, storage, recording and use of archive documents, which have been accumulated over the years of the Service existence;
5.16. As stipulated by relevant procedures and orders, liaise with governmental agencies of other states and international organizations as concerns relevant activities, including, is so requested and/or approved by the Government of the Russian Federation, representation of the Russian Federation in the World Customs Organization (Customs Cooperation Council) and other international organizations;
5.17. As stipulated by relevant procedures and orders, arrange tenders and grants governmental contracts for delivery of goods, performance of works and provision of services for the Service, and also contracts for research and development works for the Government, as concerns relevant activities;
5.18. Act as Principal in construction of Customs Houses, Customs Check Points and other installations needed for development of Customs infrastructure;
5.19. Act as Customer in respect of production of excise marks for marking alcoholic beverages, tobacco and tobacco products being imported to the customs territory of the Russian Federation;
5.20. Implement Customs Operations Development in Russian Federation Programs;
5.21. Provide measurements and calibration support to customs authorities;
5.22. Provide guarding of Customs infrastructure facilities;
5.23. Exercise any other powers concerning relevant activities if such powers are provided for in Federal Acts, legal instruments by the President of the Russian Federation of the Government of the Russian Federation.
6. To exercise its powers the Federal Customs Service shall be entitled as follows:
6.1. Set up, reorganize and liquidate regional Customs Departments, Offices and Customs Stations, including special customs units who will have limited competence in performing some specific functions assigned to customs authorities, or to fulfill customs operations with regard to particular types of goods;
6.2. Determine the region of customs authorities' operation;
6.3. Approve the general or individual regulations of the regional Customs Departments, Customs Offices and Customs Stations;
6.4. make arrangements for the conduct of necessary investigations, tests, inspections, analyses and estimations, and scientific inquiries within the established area of operations;
6.5. Request for the information required for decision-making with respect to the issues within the established area of operations;
6.6. Provide legal entities and individuals with explanations and comments with regard to the issues within the established area of operations;
6.7. Exercise monitoring, including financial control of operations performed by foreign offices and departments of the Customs Service of the Russian Federation;
6.8. Employ under the established procedure, scientific and and/or other establishments, as well as individual scientists and experts to study and/or develop issues within the authorized area of operations;
6.9. apply measures of the restrictive, precautionary and preventive nature provided by the Law of the Russian Federation to prevent and/or suppress infringements by legal entities and/or citizens, of mandatory requirements existing within the established area of operations, and to take measures to liquidate complications, consequences and aftereffects of such infringements;
6.10. Set up advisory and expert units (councils, committees, groups, boards) within the established area of operations;
6.11. Develop and approve specimen of Identification Cards and Certificates, and the uniform wearing policy;
6.12. Issue individual legal acts concerning the established area of operations.
7. The Federal Customs Service shall not be authorized to perform functions relating to the management of the state-owned property within the established area of operations and shall render no paid services, except for the cases established by Resolutions by the President of the Russian Federation and Directives by the Government of the Russian Federation.
