III. Activity Arrangement 
8. Federal Customs Service shall be headed by the Head shall be appointed to and discharged from the post by the Government of the Russian Federation.
Head of Federal Customs Service shall be personally responsible for exercising powers assigned to FCS within the established scope of activities.
Head of Federal Customs Service has Deputies, the number of which shall be determined by the Government of the Russian Federation.Deputy Heads of Federal Customs Service shall be appointed to and discharged from the post by the Government of the Russian Federation as recommended by the Head of Federal Customs Service.
Deputy Head of Federal Customs Service supervising investigation activities led by customs authorities shall report to the Head of Federal Customs Service in finance and economic activity issues, while in field operations issues, shall be authorized to take independent decisions.
9. Head of Federal Customs Service shall be authorized as follows.
9.1. Assign responsibilities among his Deputies;
9.2. Bring to the Government of the Russian Federation the following:
9.2.1. Draft Regulation on Federal Customs Service;
9.2.2. Proposals on the limiting number payroll of officials and employees of the FCS Central Office and customs authorities;
9.2.3. Propose appointments to and/or discharges from Deputy Head of FCS posts;
9.2.4. Draft annual activity plan, forecast performance, and performance report of FCS;
9.3. Bring to the Ministry of Finance of the Russian Federation proposals on setting draft federal budget as regards financing of FCS activities;
9.4. Appoint to and discharge from posts officials of FCS Central Office, Heads of Regional Customs Directorates and Custom Office Administrators, and other postholders and employees of customs authorities of the Russian Federation, including postholders and employees of FCS Representative Offices abroad;
9.5. Resolve, in accordance with the RF law on government service, issues associated with doing federal government service in Federal Customs Service;
9.6. Approve structure and manning table of FCS Central Office within the limit of postholders and employee number approved by the Government of the Russian Federation, revenue/expenditure estimate on FCS maintenance within the limits of approved budget allocations for certain periods;
9.7. Approve staffing numbers and payroll of postholders and employees of Regional Customs Directorates, Customs Offices and agencies reporting to FCS, and FCS Representative Offices in foreign states within the limits established by the Government of the Russian Federation;
9.8. Approve Regulations of FCS Central Office Divisions;
9.9. Define procedure for spending of funds allocated for measures related to operational and investigation activities by customs authorities;
9.10. Organize, to the established procedure, turnover of all small arms and other weapons, ammunition, and cold steel arms held by customs authorities
9.11. Approve Regulations on FCS Badges and Medals and Regulation on Certificate of Honor of Federal Customs Service;
9.12. Award personal arms to the procedure established by the Law of the Russian Federation, and apply other motivations provided by legal instruments;
9.13. Determine competences of customs authorities and postholders thereof to resolve organizational, HR, finance and other issues;
9.14. Issue orders within FCS competence;
9.15. Bring to the Government of the Russian Federation proposals as per established procedure on establishment, reorganization and liquidation of federal enterprises and agencies reporting to FCS.
10. Financing of Federal Customs Service maintenance costs is covered by federal budgetary funds and other sources according to the Law of the Russian Federation.
11. Federal Customs Service is an entity, has a seal featuring the National Emblem of the Russian Federation and its name, and other standard seals, stamps and forms, and maintains bank accounts established according to the Law of the Russian Federation.
12. Federal Customs Service has its duly approved emblem as a heraldic symbol, a flag and a challenge pennon.
13. The Head Office of Federal Customs Service is located in Moscow.

AMENDMENTS
to be incorporated into regulatory and legal instruments of the Russian Federation


1. Rules for Turnover of Private-use and Duty Weapons and Ammunition in the Russian Federation approved by the Government of the Russian Federation Directive 814 on 21 July 1998, "Control Measures on Turnover of Weapons and Ammunition in Private and Duty Use in the Russian Federation" (Corpus of Legislative Acts of the Russian Federation, 1998, No. 32, Art..3878; 2006, No. 3, Art. 297):
a) Para. 35. The last sentence to be deleted;
b) Para. 56, 76, 81, 84, 87 and 90: words "Ministry of Economic Development and Trade of the Russian Federation" to be replaced with "Federal Customs Service".
2. Procedure for Humanitarian Aid (Assistance) in the Russian Federation approved by the Government of the Russian Federation Directive 1335 on 4 December 1999 (Corpus of Legislative Acts of the Russian Federation, 1999, No. 50, Art. 6221; 2005, No. 52, Art. 5752), Paragraph 10: term "Ministry of Economic Development and Trade of the Russian Federation" to be replaced with "Federal Customs Service".
3. The Government of the Russian Federation Directive 416 dated 28 May 2001, "Wage and salary supplements for employees of internal affairs agencies of the Russian Federation, State Fire Service of the Ministry of the Russian Federation for Civil Defense, Emergency Situations and Relief of Natural Disasters, penitentiary agencies and authorities, customs authorities of the Russian Federation, and drug enforcement authorities, doing services in the Far North areas and equated localities and other severe climate or environment regions, including remote regions" (Corpus of Legislative Acts of the Russian Federation, 2001, No. 23, Art..2371; 2002, No. 37, Art..3530; 2003, No. 33, Art..3269; 2004, No. 8, Art. 663; No. 47, Art. 4666; 2006, No. 3, Art. 297), Paragraph 4: words "Ministry of Economic Development and Trade of the Russian Federation" to be replaced with "Federal Customs Service".

The Government of the Russian Federation Directive 566 dated 26 July 2002, "Regional Authorities of the State Customs Committee of the Russian Federation and Federal Service of the Russian Federation for Drug Control" (Corpus of Legislative Acts of the Russian Federation, 2002, No. 31, Art. 3115; 2004, No. 8, Art. 663; No. 47, Art. 4666), Title and sub-para. a.: words "State Customs Committee of the Russian Federation" to be replaced with "Federal Customs Service".
5. The Government of the Russian Federation Directive 187 dated 7 April 2004, "Issues of the Ministry of Economic Development and Trade of the Russian Federation" (Corpus of Legislative Acts of the Russian Federation, 2004, No. 15, ст.1480; № 36, ст.3670; № 38, ст.3795; 2005, № 5, ст.390; № 34, ст.3506; № 42, Art. 4278; No. 49, Art. 5222; 2006, No. 11, Art. 1182; No. 16, Art. 1735; No. 18, Art. 2005),
a) Para. 1: words "customs activities" to be deleted;

6. Ministry of Finance of the Russian Federation Regulation 329 approved by the Government of the Russian Federation on 30 June 2004, "Ministry of Finance of the Russian Federation" (Corpus of Legislative Acts of the Russian Federation, 2004, No. 31, Art. 3258; No. 49, Art. 4908; 2005, No. 52, Art..5755):
a) Para. 2: words "Federal Customs Service" to be replaced with "customs authorities";b) Sub-para. 5.2.12 to be amended to read as follows:
"5.2.12. Procedure for control over customs value of goods jointly with Federal Customs Service".
7. The Government of the Russian Federation Directive 429 dated 21 August 2004, "Federal Customs Service" (Corpus of Legislative Acts of the Russian Federation, 2004, No. 35, Art. 3637; 2005, No. 25, Art..2504):
a) The title to read as follows: "Federal Customs Service Issues";
b) Para. 1 and 2 to be rendered null and void;
c) Para. 7:
words "Ministry of Economic Development and Trade of the Russian Federation" to be replaced with "Federal Customs Service";
words "Keramichesky proyezd, d. 59," to be deleted.
8. Ministry of Economic Development and Trade of the Russian Federation Regulation 443 approved by the Government of the Russian Federation on 27 August 2004, (Corpus of Legislative Acts of the Russian Federation, 2004, No. 36, Art. 3670; 2005, No. 22, Art. 2121; 2006, No. 9, Art.1017; No. 11, Art.1182; No. 16, Art. 1743, Art. 1744; No. 18, Art. 2005):
а) Para. 1: words "customs activities" to be deleted;
b) Para. 2: words "Federal Customs Service" to be deleted;
c) Sub-para. 5.1, 5.2.51, 5.10, 6.2, 6.6, 10.2, 10.7 to 10.9, 10.11-10.15: words "federal service and" in grammatically appropriate case to be deleted;
d) Sub-para 5.2.14 to 5.2.40, 5.2.49 and 5.2.50 to be rendered null and void.
9. The Government of the Russian Federation Directive 367 dated 10 June 2005, "Introduction of Goods Nomenclature in External Economic Activities" (Corpus of Legislative Acts of the Russian Federation, 2005, No. 25, Art. 2504) Para.2 to be rendered null and void.
10. The Government of the Russian Federation Directive 666 dated 31 December 2005, "Excise Marking of Alcoholic Products" (Corpus of Legislative Acts of the Russian Federation, 2006, No. 3, Art. 300):
а) Para. 3 and 4: words "Ministry of Economic Development and Trade of the Russian Federation" to be replaced with "Federal Customs Service";
b) Rules on Application on Excise Marks of Alcoholic Product Details approved by the above Directive, words "Ministry of Economic Development and Trade of the Russian Federation" to be replaced with "Federal Customs Service".
